MEMPHIS, TN (WREG/LPL) — El Senador Lee Harris está buscando opiniones  sobre la propuesta del Departamento del Trabajo para cambiar la forma en que se pagan las propinas.
En este momento, un empleador puede pagar el salario mínimo a los meseros más propinas o recibir un crédito adicional, lo que significa que pagan menos que el salario mínimo y que las propinas compensan la diferencia.
Bajo la nueva propuesta, un restaurante podría implementar el llamado “pool” de propinas, de modo que todas las propinas se incluyan en un solo frasco y sean repartidas entre todos, incluidos los empleados de la cocina, como cocineros y lavaplatos.
Esta nueva propuesta del Departamento de Trabajo bajo la Ley de Normas Laborales Justas solo se aplicaría a aquellos empleadores que ya pagan el salario mínimo completo.
“La propuesta ayudaría a disminuir las disparidades salariales entre los trabajadores con y sin propinas, una opción que actualmente está restringida por una norma promulgada en el 2011 que ha sido cuestionada en varios tribunales”, dijo el Departamento del Trabajo en un comunicado de prensa.
Pero algunos, incluido el senador Harris, temen que el dinero no vaya siempre a los empleados.
“Según la regla propuesta, los empleadores tendrían amplia discreción sobre las propinas obtenidas por sus empleados, lo que les permitiría mantener los salarios para ellos o para el negocio”.
“Para mí es importante tener una perspectiva local sobre cómo esto podría afectar la rentabilidad de las personas”, agregó. “No estoy seguro de que los meseros sepan que este cambio propuesto podría hacerse realidad y estoy buscando sus opiniones”.
El Senador Harris planea estar en el restaurante Stein ubicado en el 2248 South Lauderdale Street el viernes, 19 de enero, a las 12:30 p.m. para escuchar de la comunidad local.

MEMPHIS, TN (WREG) — Mid-South Senator Lee Harris is seeking local input on a Department of Labor proposal to change the way tips are paid out.
Right now, an employer can either pay servers minimum wage plus tips or take a tip credit – meaning they pay less than minimum wage and tips make up the difference.
Under the new proposal, a restaurant could implement tip pooling, so all of the tips go into one jar and are dispersed among everyone – including back-of-the-house employees like cooks and dishwashers.
This new proposal from the Department of Labor under the Fair Labor Standards Act would only apply to those employers already paying the full minimum wage.
“The proposal would help decrease wage disparities between tipped and non-tipped workers – an option that is currently restricted by a rule promulgated in 2011 that has been challenged in a number of courts,” the Department said in a news release.
But some, including Sen. Harris, worry that the money won’t always go to those employees.
“Under the proposed rule, employers would have broad discretion over the tips earned by their employees, allowing them to keep wages for themselves or the business.”
“It’s important to me to get a local perspective as to how this might affect people’s bottom line,” he added. “I’m not sure that servers know that this proposed change could become a reality and I’m seeking their input.”
Sen. Harris plans to be at Stein’s restaurant located at 2248 South Lauderdale Street Friday, January 19 at 12:30 p.m. to hear from the local community.
