Judge Declares Mistrial In Nogales Rancher Murder Case
Corte declara nulo juicio al ranchero acusado de matar a un migrante mexicano en la frontera

ARIZONA (Arizona Central) — Jurors in the murder case against a Nogales-area rancher accused of killing an unarmed migrant on his property were unable to reach a unanimous verdict and remained deadlocked on the charges.
After more than 15 hours of deliberation, Santa Cruz County Superior Court Judge Thomas Fink declared a mistrial just after 4:30 p.m. The court scheduled a status meeting for 1:30 p.m. April 29 to allow the Santa Cruz County Attorney’s Office to decide if it wants to retry the case.
“They won’t wear me down,” rancher George Alan Kelly told reporters after the mistrial was declared.
The trial centered on the Jan. 30, 2023, death of Mexican migrant Gabriel Cuen Buitimea, who was found shot after Kelly fired warning shots into the air, his defense attorney said.
Kelly faced a second-degree murder charge in Buitimea’s death, and a charge of aggravated assault with a deadly weapon for putting another man, Daniel Ramirez, in danger. Ramirez had been traveling with Buitimea looking for work in the U.S. Buitimea’s body was found 115 yards, a football field away, from Kelly’s house hours after the shooting incident.
Attorneys and the judge discussing which instructions to pass on to the jury noted the jurors looked tired and frustrated earlier that day when they told the judge they were at an impasse.

ARIZONA (La Opinión) — El juez en la Corte Superior del condado Santa Cruz declaró nulo el juicio contra el ranchero George Allan Kelly, quien era acusado de asesinato en segundo grado y agresión agravada por el tiroteo fatal del 30 de enero de 2023 contra Gabriel Cuen-Buitimea, de 48 años, un migrante a quien le disparó a corta distancia, cuando huía de la Patrulla Fronteriza en Arizona.
De acuerdo a la información oficial, Cuen-Buitimea viajaba con un grupo de migrantes que corrieron cuando vieron agentes de la patrulla fronteriza en el área. El migrante y otro acompañante supuestamente regresaban al lado sur de la frontera cuando pasaron por el rancho ganadero de Kelly.
Fue entonces cuando los fiscales alegaron que Kelly disparó imprudentemente su AK-47 desde una distancia de unos 115 metros, hiriendo fatalmente a Cuen-Buitimea en la espalda.
El jurado comenzó a deliberar el jueves, pero desde el pasado viernes informó al juez que no había podido llegar a una decisión.
El juez pidió al jurado seguir deliberando, pero nuevamente informó a la corte que no podía llegar a un acuerdo.
Después de más de 15 horas de deliberación, el juez del Tribunal Superior del Condado de Santa Cruz, Thomas Fink, declaró el juicio nulo. El tribunal programó una reunión sobre el estado para el 29 de abril para permitir que la Oficina del Fiscal del Condado de Santa Cruz decida si quiere volver a intentar el caso.
Durante el juicio, que comenzó a principios de abril, la Fiscalía aseguró que Kelly, de 75 años, disparó de forma “intencional” contra un grupo de migrantes sin ningún tipo de advertencia.
