A common issue facing beneficiaries of an I-130 petitions that are forwarded to the National Visa Center is keeping that petition active even if you are unable to complete the visa process at that time. If you cannot complete consular processing of a visa that is otherwise immediately available, then you must contact the National Visa Center (NVC) once a year to avoid having the NVC take steps to terminate your petition and eventually destroy the application. An example of having a visa available, but not wishing to pursue it immediately would be the filing of an I-601A waiver from inside the US. You need to notify the NVC each year that you wish to continue processing your case without being ready to schedule an interview.

Below is the rule explaining the process for terminating inactive cases:

9 FAM 504.13-2(A) Termination of Inactive Cases

INA 203(g) provides for termination of registration of the visa petition of any alien who fails to apply for an immigrant visa within one year following notification to the alien of the availability of such visa. But INA 203(g) also permits reinstatement of the registration where the alien establishes within 2 years following the date of notification of the availability of such visa that such failure was due to circumstances beyond the alien’s control.

The most common way we see I-130 petitions get terminated at the NVC is when the applicant has not made an application for a visa within one year of notice of visa availability. The applicant has one year to submit an application for a visa, beginning on the date the notice of visa availability is issued. Another common way the visa is terminated is when the applicant does not respond to the appointment notice included with the Immigrant Visa Appointment Package, meaning that the applicant fails to appear for a visa application interview on the scheduled appointment date and fails to take further action on the case within one year of the scheduled interview.

The NVC will also send information for the applicant to satisfy the necessary steps to apply for the immigrant visa.  If steps are not timely completed, the NVC will advise the Applicant, through an MFL letter, what steps to take to avoid possible termination of their visa. The most frequent response we see is to notify the NVC that you “wish to pursue my immigrant visa application, please send me information on applying for my immigrant visa.  I understand I will have to resubmit all required fees and documents in order to continue the immigrant visa processor.” This response to the NVC will stop the termination process and return your petition to active status.  If you have already received your green card, you may want to notify them that you are no longer interested in consular processing.

If you fail to respond to the MFL letter, then one year later the NVC will send you a Termination 1 Letter (TL1.)  During this next one-year period, the NVC will allow you to request a discretionary reinstatement of your visa petition if you can show the termination was due to “reason beyond the applicant’s control” for not pursuing the application. You must show whether an applicant has established that the failure to apply for the visa was due to circumstances beyond applicant’s control is a factual determination to be made by the consular officer and depends upon the consular officer’s assessment of the unique circumstances of the case. Circumstances beyond the applicant’s control will generally be factors that have arisen outside of the applicant’s normal circumstances, including medical emergency or natural disaster.

After the anniversary of the TL1 letter, NVC will send a TL2 letter which officially terminates the petition. This does not allow you to request reinstatement, since that opportunity was provided during the one year prior to the TL2 letter. After receiving a TL2 letter, you may have to file a new I-130 and start the process over from the beginning. This area of Immigration law has become complicated and has posed problems for many people who have not changed their address with DHS or provided an email address so that Government Agencies can easier correspond with you.

La INA 203 (g) dispone la cancelación del registro de la petición de visa de cualquier extranjero que no solicite una visa de inmigrante dentro del año siguiente a la notificación al extranjero de la disponibilidad de dicha visa. Pero la INA 203 (g) también permite el restablecimiento del registro cuando el extranjero establece dentro de los 2 años siguientes a la fecha de notificación de la disponibilidad de dicha visa que tal incumplimiento se debió a circunstancias fuera del control del extranjero.

La forma más común en que vemos que las peticiones I-130 se cancelan en el NVC es cuando el solicitante no ha presentado una solicitud de visa dentro de un año de la notificación de la disponibilidad de la visa. El solicitante tiene un año para presentar una solicitud de visa a partir de la fecha en que se emite el aviso de disponibilidad de visa. Otra forma común en que se cancela la visa es cuando el beneficiario no responde al aviso de cita incluido con el Paquete de Cita de Visa de Inmigrante, lo que significa que el solicitante no se presenta a la entrevista de solicitud de visa en la fecha de la cita programada y no toma más medidas en el caso dentro de un año de la entrevista programada.

El NVC también enviará información al solicitante para cumplir con los pasos necesarios para solicitar la visa de inmigrante. Si no se toman las medidas oportunamente, el NVC informará al solicitante, a través de una carta de MFL, qué medidas tomar para evitar una posible cancelación de su visa. La respuesta más frecuente que vemos es notificar al NVC que usted desea continuar con la solicitud de visa de inmigrante. “Por favor, envíeme información sobre cómo solicitar mi visa de inmigrante. Entiendo que tendré que volver a enviar todas las tarifas y documentos requeridos para continuar con el procesador de visas de inmigrante”. Esta respuesta al NVC detendrá el proceso de cancelación y devolverá su petición al estado activo. Si ya recibió su tarjeta de residencia, es posible que desee notificarles que ya no está interesado(a) en el procesamiento consular.

Si no responde a la carta de MFL, entonces un año después, el NVC le enviará una Carta de Terminación 1 (TL1). Durante este próximo período de un año, el NVC le permitirá solicitar un restablecimiento discrecional de su petición de visa si puede demostrar que la cancelación se debió a “motivos ajenos al control del solicitante” para no continuar con la solicitud. Debe demostrar que la falta de solicitud de la visa se debió a circunstancias fuera del control del solicitante; es una determinación fáctica que debe tomar el funcionario consular y depende de la evaluación del funcionario consular de las circunstancias únicas del caso. Las circunstancias que escapan al control del solicitante generalmente serán factores que han surgido fuera de las circunstancias normales del solicitante, incluida una emergencia médica o un desastre natural.

Después del aniversario de la carta TL1, el NVC enviará una carta TL2 que cancela oficialmente la petición. Esto no le permite solicitar la reinstalación, ya que esa oportunidad se brindó durante el año anterior a la carta TL2. Después de recibir una carta TL2, es posible que deba presentar un nuevo I-130 y comenzar el proceso desde el principio. Esta área de la ley de inmigración se ha complicado y ha planteado problemas a muchas personas que no han cambiado su dirección con el DHS o no han proporcionado una dirección de correo electrónico para que las agencias gubernamentales puedan comunicarse más fácilmente con usted.
