We Expect the Immigration Court to Reconvene in Memphis with Hearings on July 6, 2021

Based on recent EOIR statements about the Memphis Immigration Court, we are hearing a few important developments.  It does look like hearings with be held in Memphis Immigration Court starting July 6, 2021.  The last time we had hearings held in Memphis Immigration Court was in March 2020.  There could be further postponements announced by EOIR, but there is a consensus by many that with the mask mandate lifted and a 50% vaccination rate for US adults, the Court may try to hold hearings following CDC guidelines using social distancing and mask policies, where needed.

We have also heard that EOIR will be expanding the number of courtrooms in Brinkley Plaza, home of the Memphis Immigration Court.  Completion of this work will likely be delayed into the year 2022.  It is expected that when additional Judges are added in the Memphis Court, that hearings will be advanced on the docket to an early date.

That is why it is so important that the Immigration Court have your correct address.  If you move, you must file an AR-11 with USCIS as well as a form E-33 which must be submitted within 10 days of moving to a new address.  The Government is only required to send correspondence, such as a new notice of hearing, to the last known address provided by the Respondent to the Immigration Court.  If you fail to appear, you may be ordered removed in your absence.  To reopen your case, you may need to prove that you properly notified the Government of your change of address within 10 days of moving.

The Immigration Court is requiring lawyers to prepare certain cases in advance of the scheduled trial days, which may be years away.  My belief has been that the Court wants to have as many cases ready for trial so they can advance cases for trial in a short period of time, such as 30-60 days from the time an opening is available a Judge’s docket.  Also, if documents are not timely filed or applications for relief are not timely submitted to the Court, then the relief sought by the Respondent may be weakened or deemed abandoned.

It is very important that each person before the Immigration Court check their hearing date with the Immigration Court on a regular basis.  This will help you check for any changes in your hearing date, in case you do not receive your written notice at your current address.  We suggest you call the EOIR hotline at 1-800-898-7180 and follow the prompts in English or Spanish.  If you want to check electronically, then you can inset your alien number on the EOIR website through their Automated Case Information System.  https://portal.eoir.justice.gov/InfoSystem/Form?Language=EN.  As a last resort, you can call the Immigration Court during normal business hours at 901-528-5883.

If you are given the advice not to attend your hearing, that is terrible advice.  Please attend your hearing so that you may have an opportunity to have your day in Court.  You may have relief from removal that you are not aware of.  The Government may change their policy and return to a policy of prosecutorial discretion that may allow long delays in your case so that other enforcement priorities can have their cases heard faster.  Be sure to get competent legal advice from an Immigration Lawyer you trust.  For many people, what is at stake at these hearings can be of “life & death” consequences.
