USCIS Website Accepts Online Requests for Records under the Freedom of Information Act

It is becoming more difficult to avoid using the internet these days. Whether it is for shopping on Amazon, or researching topics using Wikipedia or making international phone calls through your favorite App. More people are using Facetime, Facebook, Messenger, WhatsApp & WeChat, LinkedIn (among others) to connect with family & friends locally and around the world. Imagine not having access to any of these tools we rely on so frequently.

Now USCIS has come into the 21^st century and distributes so much information online, it is hard to ignore the importance of being connected to the Web. In a world where “information is power,” the web has an abundance of information instantaneously available which was unimaginable over 30 years ago when I first became a lawyer.  I find myself now directing people to the Government websites to get information “straight from the horse’s mouth.”

For many of my clients, obtaining a copy of their file with USCIS is a valuable tool for me to use in advising clients how to proceed on their future cases. USCIS has now made it easier and faster to request records online https://www.uscis.gov/records/request-records-through-the-freedom-of-information-act-or-privacy-act under the Freedom of Information Act and the Privacy Act. This link will provide more details on how to make these online requests.

Under the Freedom of Information Act (FOIA) and the Privacy Act (PA), you can request Immigration records, whether your own or someone else’s with their permission; and agency policies, data, communications, and other records. USCIS reminds us that if you request specific documents instead of the entire file, USCIS will be able to process your request quicker. We prefer to request the entire file, but if we just needed a copy of a naturalization certificate from the file, we would ask for that specific document in order to get a faster response to our record request.

If USCIS can’t locate a file under your name or alien number, they will quickly respond to you because the file will not have to get in line for the FOIA review process. If you have a scheduled hearing before the Immigration Judge, USCIS will prioritize your FOIA request to deliver it faster. USCIS recommends that you attach a document issued by the Department of Homeland Security to assist them in locating your records such as: Form I-862, Notice to Appear, documenting the upcoming date of the subject’s hearing before the immigration judge; Form I-122, Order to Show Cause, documenting the upcoming date of the subject’s hearing before the immigration Judge; Form I-863, Notice of Referral to Immigration Judge; or a written notice of continuation of a future scheduled hearing before the Immigration Judge.

USCIS further states that your requesting records online can instantly get your record request in line for processing; confirm that USCIS received your FIOA request; be notified when we process it; track the status of your FOIA request and conveniently access your records without the time and expense of completing paperwork, using the US Postal Service or other mail delivery services.

USCIS states that requesting FOIA records online are easy to access from a phone, tablet, or computer; send to another person and download and print the entire document or portions that you choose to print straight from your computer or device.

USCIS reminds us that we can receive records online even if we did not file for immigration benefits online.  USCIS requests that you request your records through their USCIS online account, which allow you to check the status of your request with USCIS. The link provided in this article will assist you in learning more about the FOIA process and the online account you can set up with USCIS. It will also provide you with the process to appeal documents denied to you through your FOIA request. Si tiene una audiencia programada ante el juez de inmigración, USCIS priorizará su solicitud de FOIA para entregarla más rápido. USCIS recomienda que adjunte un documento emitido por el Departamento de Seguridad Nacional para ayudarlos a ubicar sus registros, como: Formulario I-862, Notificación de comparecencia, que documente la próxima fecha de la audiencia del sujeto ante el juez de inmigración; Formulario I-122, Orden para Mostrar Causa, que documente la próxima fecha de la audiencia del sujeto ante el juez de inmigración; Formulario I-863, Notificación de Referido a un juez de inmigración; o una notificación por escrito de la continuación de una audiencia programada para el futuro ante el juez de inmigración.

USCIS establece además que sus registros solicitados en línea pueden instantáneamente poner su solicitud de registro en línea para su procesamiento; confirmar que USCIS recibió su solicitud FIOA; ser notificado cuando lo procesemos; monitorizar el estado de su solicitud de FOIA y acceder cómodamente a sus registros sin el tiempo y los gastos de completar el papeleo, utilizando el Servicio Postal de los EE. UU. u otros servicios de entrega de correo.

USCIS establece que es fácil acceder a la solicitud de registros FOIA en línea desde un teléfono, tableta o computadora; enviarlo a otra persona y descargar e imprimir todo el documento, o partes del mismo, directamente desde su computadora o dispositivo.
