Board of Immigration Appeals Decided to Reopen the Case of Journalist Manuel Duran
ALABAMA (Memphis Noticias) — La decisión llega meses luego de que un panel de tres jueces del Onceavo Circuito diera a conocer su decisión de que el caso de Manuel debía ser enviado de regreso a la Junta de Apelaciones de Inmigración para ser revaluado.
La juez Beverly Martin, uno de los miembros del panel, había escrito en la orden que Manuel “ha demostrado que es probable que tenga éxito en los méritos de su argumento”, y que su caso debía ser reabierto.
“Estoy satisfecho con el resultado positivo en el proceso. Creo que de tantas malas noticias que hemos tenido durante todo este tiempo, esta es la primera buena noticia. Espero que todo siga marchando bien y pronto estar fuera. Como siempre, gracias a todas las personas que me han brindado su apoyo” declaró Manuel por teléfono.
Manuel fue arrestado el 3 de Abril de 2018 por la policía de Memphis mientras cubría una demostración pacífica en el centro. Fue el único periodista arrestado ese día. Permaneció detenido por dos días luego de que su fianza había sido pagada.
Los cargos en su contra fueron retirados dos días después de su arresto y su caso fue desestimado, pero Manuel fue entregado inmediatamente a inmigración y trasladado a LaSalle ICE Processing Center en Jena, Louisiana el 5 de Abril de 2018.
Desde entonces, Duran ha sido trasladado cuatro veces a distintas instalaciones.
Él ahora se encuentra detenido en Etowah County Detention Center. Una cárcel del condado Etowah en Gadsden, Alabama que tiene un contrato con Inmigración y les alquila espacio.

ALABAMA (Memphis Noticias) — The decision comes months after a panel of three judges from the Eleventh Circuit announced its decision that Manuel’s case should be sent back to the Board of Immigration Appeals to be re-evaluated.
Judge Beverly Martin, one of the panel members, had written in the order that Manuel “has shown that he is likely to succeed in the merits of his argument,” and that his case should be reopened.
“I am satisfied with the positive result in the process. I think that from all the bad news we’ve had during all this time, this is the first good news. I hope everything continues to go well and soon be out. As always, thanks to all the people who have given me their support, “Manuel said by telephone.
Manuel was arrested on April 3, 2018 by the Memphis police while he was covering a peaceful demonstration at the center. He was the only journalist arrested that day. He was detained for two days after his bail had been paid.
The charges against him were dropped two days after his arrest and his case was dismissed, but Manuel was immediately handed over to immigration and transferred to LaSalle ICE Processing Center in Jena, Louisiana on April 5, 2018.
Since then, Duran has been transfer four times to different facilities.
He is now being held at the Etowah County Detention Center. An Etowah County jail in Gadsden, Alabama that has a contract with the Immigration Agency and rents them space.
